READ THIS DOCUMENT CAREFULLY AND IN FULL BEFORE BOOKING WITH US TO PARTICIPATE IN THE RIDE. THIS DOCUMENT HAS LEGAL CONSEQUENCES AND WILL AFFECT YOUR LEGAL RIGHTS AND WILL LIMIT YOUR ABILITY TO BRING FUTURE LEGAL ACTIONS

THE RULES

1. By signing this Agreement You acknowledge your understanding and full acceptance of these conditions, any further terms and conditions provided to you by us in respect of The Ride from time to time, the Rules, and any instructions given to You by the organisers and officials at The Ride (together, the “Conditions”).

2. In order to successfully complete The Ride You will cycle the complete route set out in the riders manual, from start to finish, while observing all relevant Conditions.

3. At all times during The Ride You agree to be Self-Supported. Breach of this term is fundamental and will result in your immediate disqualification from The Ride.

4. You acknowledge and understand that it is your personal responsibility to arrange for insurance cover for The Ride. We will not provide insurance cover for The Ride.

5. You consent to medical care and transportation in order to obtain treatment in the event of injury to you and waive any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury. You understand that no medical care may be available, but if it is, you assume liability for any and all medical expenses incurred as a result of your participation in The Ride and any treatment you may receive.

6. You will not enter and participate in The Ride unless you are medically able and properly trained and it is your responsibility to monitor your own physical condition throughout The Ride. You warrant to us that on The Ride start date you will be in good health and in proper physical condition to safely participate in The Ride and that you are aware of the risks of participating in The Ride. If you are in any doubt we recommend that you do not attend The Ride and seek medical advice.

7. You understand and agree that you must give us accurate medical information. It is your responsibility to ensure that this information is correct. We will not be liable to you for any loss, damage or mis-treatment/mis-diagnosis that may result from any such information being inaccurate, misleading or incomplete. This medical information will only be used by us to assist in the giving of medical treatment, if required, during the The Ride.

8. You will observe all relevant laws, byelaws and regulations; you will wear a helmet at all times and a reflective vest at night when cycling during The Ride. You will have strong front and rear lights and additional reflective strips on bicycle frame and wheels.

9. You recognise that The Ride may take place in varied or adverse weather conditions. You are expected to prepare yourself for the conditions of the day accordingly

10. You are responsible to record and maintain documentary evidence of your progress on The Ride, such as by uninterrupted GPS tracking. If Your tracker breaks, You are permitted to record progress through other means, ie. Garmin, Strava, RideWithGPS, etc.

11. You will pay the Start Fee in order to participate in The Ride. The Start Fee is non-refundable in so far as the law permits. If you cancel participation in The Ride before its start date we reserve the right to allow you to transfer the Start Fee to pay for participation in a future event by Us

12. We reserve the right to cancel The Ride if:
1. circumstances beyond our reasonable control arise which affect the safety and security of the participants and/or spectators or affect our ability to hold The Ride, including, without limitation, war, civil or political unrest, terrorism or inclement weather conditions; or
2. before the The Ride’s start date we have not, in our sole discretion, received a sufficient number of applications to ensure that there are enough attendees/participants to make the Event viable.
Where practicable, we will provide written notice of cancellation to the email address we hold for you. In the event notice by email is not practicable due to timescales we will use reasonable endeavours to provide other suitable methods of notice including text message, updates to our website, etc.
In the event of cancellation of The Ride you may receive a refund of the Start Fee or the offer to offset the Start Fee against a future event, but any such refund will be at our sole discretion (acting reasonably). We will not, under any circumstances, be responsible for travelling or associated expenses.

13. You confirm that the email address, phone number and other personal details you provide to us are all accurate, correct and up to date.

14. Breach of any the Conditions may result in Your disqualification from The Ride and we reserve the right to exclude you from participation in/attendance at our future events.

15. If any term of this Agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term will be excluded to the extent of such invalidity or unenforceability; all other terms hereof will remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable term will be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term.

LIMITATION OF LIABILITY TERMS AND CONDITIONS AND TERMS AND CONDITIOSN CONCERNING PERSONAL DATA, IMAGERY AND PHOTOGRAPY PERMISSIONS

1. By signing this Agreement You acknowledge your understanding and full acceptance of these conditions, any further terms and conditions provided to you by us in respect of The Ride from time to time, the Rules, and any instructions given to you by the organisers and officials at The Ride (together, the “Conditions”). In exchange for my participation in Two Volcano Sprint (2VS) events and activities, you acknowledge, understand, accept and agree to the following clauses:

Our responsibility for loss or damage suffered by you

2. Participation in The Ride is a hazardous activity. The risk of injury as a consequence of your participation in The Ride is significant due to its Prevailing Circumstances. Risks include the potential for your serious bodily injury, permanent paralysis and death. While Your strict observance of medical advice, laws, legal duties, Conditions, use of proper equipment and personal discipline may reduce the risk, the risk of serious injury still exists; and,

3. YOU KNOWINGLY AND FREELY RECOGNISE, AGREE TO ASSUME ALL RISKS AND CONNECTED CONSEQUENCES, BOTH KNOWN AND UNKNOWN, ARISING FROM AND CONNECTED TO YOUR PARTICIPATION IN 2VS EVENTS AND ACTIVITES, INCLUDING BUT NOT LIMITED TO ‘THE RIDE’, EVEN IF ARISING FROM THE ERROR IN JUDGEMENT OR LAPSE IN SKILL OF FELLOW CYCLISTS or others to the fullest extent allowed by the law.

4. As a participant in 2VS you understand that you legally owe all other participants and those reasonably foreseen to be impacted by your activities, a duty of care. This duty of care is to exercise all care that is objectively reasonable in the Prevailing Circumstances in order to avoid injury to fellow participants, their property or to third parties reasonably foreseen to be at risk by your actions or inactions. This duty includes an obligation on you to report to the necessary individual or organisation, and as soon as is possible, any significant risk or hazard you encounter, notice or foresee.

5. If objectively reasonable, you will stop and assist any other unattended to participant in The Ride who is in need of urgent medical attention and alert the relevant authority and 2VS organisers as soon as possible.

6. We accept no responsibility for the loss of, theft, or damage to any property owned by or under the control of you which you bring to The Ride. You are solely and personally responsible for the safety of your belongings.

7. To the fullest extent permitted by law, you for yourself and on behalf of your heirs, assigns, personal representatives and next of kin, HEREBY FOREVER WAIVE, RELEASE, DISCHARGE AND HOLD HARMLESS Two Volcano Sprint directors, officers, officials, agents, volunteers and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event and all other persons associated with The Ride, WITH RESPECT TO ANY AND ALL LIABILITIES, CLAIMS, ACTIONS OR DAMAGES THAT YOU MAY HAVE AGAINST US ARISING OUT OF OR IN ANY WAY IN CONNECTION WITH YOUR REGISTRATION AND PARTICIPATION IN THE RIDE INCLUDING, WITHOUT LIMITATION, ANY LIABILITY OR CLAIMS INVOLVING INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE ACTIONS OR INACTIONS OF THE ABOVE PARTIES OR OTHERWISE,

8. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Personal information, photographs and imagery

You agree that we can use the personal information that you provide to us when registering for or in connection with The Ride:
1. in the case of an emergency – the emergency contact details and medical information you provided may be used to allow medical assistance to be given to you.
2. to store, use, and share with group companies and partners, in connection with the Event. By giving us your personal information, you expressly consent to our collection, use and disclosure of your personal information. When you submit personal information to us, we may use it to contact you, and we may provide it to certain third parties, for marketing or promotional purposes.
3. to compile reports on results of The Ride to be published to 2VS or any affiliated organisation for the purpose of insurance, permits or for any other purposes so required.
4. to publish The Ride results on our website after the Event.
You have the right to ask us not to process your personal data for marketing purposes and You may always opt-out of receiving future e-mail messages and newsletters from us.
10. The Ride may be recorded and videos, photographs and other recordings may be taken, where you may be captured participating. You agree to the publication of such photographs, videos, recordings, and/or likenesses of you (whether edited, adapted, modified or copied) and their use by us and those authorised by us, without prior notice or compensation, in any way which we may see fit now or in the future including but not limited to film, broadcast, radio, TV, publications, future events, press kits, annual reports, social networking sites, and publicity. You acknowledge that we have the full right to sell and/or profit from the commercial use of such photographs, motion pictures, recordings, and/or likenesses of you.

Any audio, visual, or audio-visual recordings that you make of the Event or any part of it are for your personal use only and cannot be published or used for any commercial purpose without our prior written consent.

In these conditions, the following terms have the meanings specified below:

Conditions: Will have the meaning given in clause 1

The Ride: means the Two Volcano Sprint 2024 event in which you will attempt to complete from start to finish, within given time parameters, the cycling route set out in the riders’ manual you will be given. The route may be subject to

Self-Supported: should be construed on its ordinary common-sense meaning and allows any food, drink, medication, clothes and equipment carried with you on The Ride or acquired by you at commercially available services. It excludes any and all 3rd party support and/or privately organised support of food, drink and/or equipment, or support of any other kind which is not equally available to all cyclists during The Ride and which may reasonably be deemed to confer an unfair advantage to you during The Ride. If any dispute arises as to the meaning of ‘Self-Supported’ the interpretation and decision given by Two Volcano Sprint 2024 will be final.

Start Fee: means the amount paid or payable to us in consideration for your participation in The Ride
You/your/yourself means the person named on the Registration Form who will be attending/participating in The Ride

We/us/our means Two Volcano Sprint

Rental Tracker Terms

The tracking device is your responsibility once it is handed over to you, by the organisation, at the start of the event.
The tracking device needs to be returned to the organisator, by the registered user, as soon as possible and within max. one week after finishing or scratching.
In case of loss or total damage of the tracking device, a € 150,00, ex. TAX, fee will be charged upon the registered user.

The tracker can be charged through USB-C, a cable is NOT included! Make sure to take one.
